Performance and Contract Management
The proactive management of long term contracts is absolutely critical to their success. Even the best procurement processes can only hope to deliver a fit for purpose contract for the initial period of a service. As time goes by there can and often is considerable contractual ''drift'' where - often for perfectly sensible reasons - the parties have adopted alternative practices and procedures that best reflect the changing day to day realities of the service. These changes should be encouraged as they are often healthy and pragmatic responses that usually deliver perfectly equitable and just outcomes. It is crucial however to ensure that these changes are proactively monitored and incorporated into the contract at regular intervals. In addition to managing and monitoring these changes it is also critical that the parties also proactively manage the key underlying contractual elements such as: performance management, financial management and the monitoring of critical but ad hoc provisions such as annual audits, benchmarks, IPR/Asset and documentation maintenance etc.
At RPC we offer a range of Performance and Contract Management services ranging from the management of full monthly service reviews through to Annual Health Checks. As part of this service we will ensure that contractual drift is minimised whilst maintaining good practice and pragmatic local changes.
